Gardaí Withdraw Prosecution Against Man Accused Of Speeding

Gardaí have withdrawn a prosecution against a man accused of speeding after he won a court order securing a copy of an €80m contract with the Go Safe consortium.

At Ennis District Court, a solicitor for the accused man claimed the State was "dodging the bullet" in not releasing the contract.

The Go Safe Consortium has come under scrutiny in the past 18 months, with judges throwing out large numbers of Go Safe speeding cases, including here in Clare.

At Ennis District Court yesterday, during one such case, Judge Patrick Durcan acceded to an application for Gardaí to make available a copy of the Go Safe contract.

However, Gardaí told the court they were withdrawing the prosecution, and as a result the order to release the contract has fallen.

Inspector John O'Sullivan also said that if a similar order was made in the future, regarding the contract, Gardaí would oppose it too.

Solicitor Daragh Hassett claimed the state was "dodging the bullet" in not releasing the contract.

Mr. Hassett, who was representing the accused in the case, said that he "rarely, if ever" disagrees with a decision to withdraw a prosecution, but described it as "completely unfair."
