Judge Rules Go Safe Staff Don’t Have Authority To Prosecute Cases As Case To Be Referred To High Court

A judge at Ennis District Court has ruled that employees of the company that operates the network of speed camera vans throughout ireland don't have the required authority to help prosecute speeding cases in the district court.

The ruling by Judge Patrick Durcan comes in a test case which will now spark a fresh High Court challenge to the legislation which allows the privately owned firm to be involved in the prosecution of speeding motorists.

Go Safe employees are required to go to court to give evidence where speeding motorists haven’t paid their speeding fines.

However, in a test case brought forward by Ennis solicitor Daragh Hassett, Judge Durcan said the Go Safe employees should have a warrant that gives them specific powers to carry out their duties, like Revenue Commissioner officers and Traffic Wardens.

The judge gave Insp Tom Kennedy and Mr Hassett two weeks to agree terms and make their arguments for the case to go forward to the High Court.
