Environmental Campaigner Fails In High Court Bid To Halt Killaloe Bridge

An environmental campaigner has failed in his bid to further appeal plans for a long-awaited bridge in Killaloe.

THe 40 million euro development is seen by many as being key for the East Clare region, but has been subject of a long running legal battle.

The Shannon River Crossing Project, which also includes a new bypass for the twin towns of Killaoe and Ballina, as well as other roadworks, was given the green light by An Bord Pleanala in 2013.

However, a judicial review of the decision was carried out after a case was brought by environmentalist Peter Sweetman, and an environmental protection company called "The Swans and the Snails Ltd".

They claimed the the project would result in the direct, permanent, and irreversible destruction of a woodlands habitat.

Last month, the High Court ruled that the decision to permit the development could stand, and now Mr. Sweetman and the company have been refused leave to bring a further appeal.

In his ruling, Mr. Justice Paul McDermott has dismissed claims that the court's decision dismissed claims that the case raised points of law of exceptional public importance.

Peter Sweetman has told Clare FM that a decision on whether to bring the matter further will be made in the coming week, while Clare County Council says it's taking legal advice in relation to the outcome and next stages in the process.

The local authority adds that it's objective is to progress the scheme as quickly as possible.

Funding for the project has been contained within the 2016-2021 Capital Investment Plan.
