DPP Appeal date set over Dinan Sentence

 

A date has been set for the DPP to appeal the leniency of the sentence handed down to two  men jailed for the death of Clare school teacher Brian Casey.

The case against Harry and Kevin Dinan will be heard at the New Courts Complex in Dublin in early December.

26 year old Lissycasey native  Brian Casey  was set upon in what’s been described as a cowardly and unprovoked attack while out in Ennis on Saint Stephen’s night 2009

He never regained consciousness and died two days later in hospital.

Last November, 31 year old Harry Dinan of 10 Waterpark Heights Ennis was jailed for five years his manslaughter while his 24 year old nephew Kevin Dinan of 3 Clarehill Clarecastle was handed down a four year prison term for the same offence.

Harry Dinan who has 64 previous convictions was on temporary release from prison at the time of the unlawful killing, while his nephew who has 17 previous convictions was on bail and awaiting sentence to a burglary charge.

Late last November the Director of Public Prosecution  lodged an application with the courts to appeal the leniency of the sentences and that case will now be heard at the Court of Criminal Appeal on Monday the 5th of December.
