Ballyvaughan widow awarded 1.5 million over husbands death

A North Clare mother of four has been awarded almost 1.6 million euro by the High Court arising from the death of her husband through negligence by UHG.

Most of the money arose due to the loss of an expected inheritance of the man’s mother’s farm which had initially been left to him but the will was altered after he died.

Grace Davoren, from The Barn, Ballyalben, Ballyvaughan, sued the HSE, along with two consultants after the death of her husband Michael in August 2003

The defendants did not contest liability in relation to Mr Davoren’s treatment for colitis.

Ms Davoren had claimed that along with being entitled to damages for loss of dependency – she also lost out on an expected 1.5 million inheritance of his family farm.

She told the High Court that her husband was an only son who worked on the family farm all his life and was due to inherit it – He also ran their own nearby farm.

However after his death, relations between herself and her mother in law Maura Davoren deteriorated and the latter changed her will twice- firstly so it benefited her grandson and then again – passing the entire estate to her daughter Mary O Regan.

The court ruled in her favour that Michael Davoren would have inherited the farm had he not suffered wrongful death and awarded his widow over 1.3 million for loss of inheritance- She was also awarded a further 189 thousand for loss of income, general damages and other expenses.
