Judgement in Stokes School Case

A judgement will be delivered later in a landmark case of a Traveller boy’s right to attend a local secondary school.

John Stokes who’s from a Traveller family, was refused admission to the Christian Brothers High School in 2010 having failed on priority grounds and later missing out on an admissions lottery.

John’s Mother Mary lodged a complaint with the Equality Tribunal who found in John’s favour and granted him a place.

However the Circuit Court overturned that decision in July last year – they say the policy of giving priority to sons of past pupils was indirectly discriminatory against Travellers but WAS objectively justified in the circumstances.

This was appealed to the High Court – where a judgement on the issue will be heard later today.
