Council granted High Court injunction over Barefield Travellers

The High Court has granted an injunction against members of an extended traveller family from illegally camping on land off the Ennis By-pass, though they’ve already vacated the site.

Clare County Council sought the injunction against members of the O’Donoghue Family who’d been illegally parked in the Barefield area for more than 7 months.

Six traveller families including 10 children who are part of the wider O’Donoghue family moved their caravans on to land off the link road to the Ennis BY-pass last September, much to the concerns of Barefield residents.

The O’Donoghue family told Clare FM they had nowhere else to go but Clare County Council said the encampment seriously impacted on the community and initiated proceedings before the High Court.

Having considered the case this week Mr Justice Murphy accepted an undertaking given by one defendant, who appeared in court, not to return to the lands in Barefield and  made an Order prohibiting the other named Defendants from returning their temporary dwellings the area. 

The Court also awarded costs to the Council but heard that members of the O’Donoghue family have now left the illegal site, with the last of their temporary dwellings being removed from the area just prior to the High Court hearing.
