IAA employee dismissal appeal upheld

Shannon based Irish Aviation Authority employee has secured an injunction preventing her from being put on leave pending an appeal against her dismissal.

The High Court heard that Regina Wallace, based at the IAA’s training centre in Ballycasey – had 759 sick days over a nine year period and was dismissed after missing a day’s work in February.

In an affidavit to the court the IAA claimed she had an unprecedented level of absenteeism.

In his judgment, Mr. Justice Hogan said Ms Wallace’s employment had not been without incident and had found it necessary to make two complaints of bullying and harassment against two superior officers, one was upheld- the other is being investigated

He also stated that one of the people, Ms Wallace had made a complaint against was present at a disciplinary hearing to investigate her absence from work in February.

Mr. Justice Hogan granted her an injunction and said he was doing so having regard to the special circumstances in the case.
