Kilrush Man Seeks Further Appeal To Murder Conviction

A West Clare man convicted of the murder of his neighbour is applying to bring an appeal against that conviction to the Supreme Court.

In 2010, Brendan O’Sullivan was convicted of the murder of Leslie Kenny who he shot in the garden of his own home at O’Gorman Street, Kilrush in July of the previous year.

The now 29 year old had admitted shooting his neighbour but had denied murder claiming he was only protecting his family from threats made by the victim that he would slit his daughter’s throat and pour petrol in the door.

However, he was subsequently found guilty by the jury after less than three hours of deliberations.

In June of this year, O’Sullivan lost an appeal against that conviction – he had claimed that Justice Patrick McCarthy didn’t properly explain to the jury when verdicts of manslaughter or self-defence should be returned, but the Court of Criminal Appeal had found there was no miscarriage of justice.

Today, O’Sullivan’s case returns before that same court as he applies to bring a further appeal against his conviction to the Supreme Court.
