Joe O’Reilly to Appeal Murder Conviction

Ten years after the murder of Rachel O'Reilly, her husband Joe O'Reilly is applying to have his conviction for her murder declared a miscarriage of justice.

The 30 year old mother of two was beaten to death in a bedroom at her home in the Naul in North Dublin on October 4th 2004.

Rose and Jim Callely sat at the back of the Court of Criminal Appeal this morning.

Joe O'Reilly the man serving life for killing their daughter Rachel at home in the Naul ten years ago was not present.

In 2007 a jury convicted him of his wife's murder and in 2009 he lost an appeal against that conviction.

Joe O'Reilly still maintains his innocence and he now wants his case reviewed as an alleged miscarriage of justice on the basis that a new or newly discovered fact has come to light.

A similar application was struck out last year because it was not ready to be heard– his case will in part focus on the fact that the book of evidence was left in the jury room during his trial.

The State has indicated that it is going to try get this latest appeal dismissed.
