Clare Council found guilty of safety breaches leading to employee death

County Council has been fined 50 thousand Euro for its "abject failure" to comply with health and safety regulations resulting in the death of an employee.

In sentencing the local authority at Ennis Circuit Court today Judge Gerard Griffin said senior figures in the council were guilty of "gross negligence" and "a grave derogation of duty" which directly lead to Tomas O Grady suffering serious injuries at a roadworks site near Tulla on the 17t of May 2006.

The father of four from Ennis was catapulted from a 9 ton dump truck he was driving when it went over an embankment at the roadworks site and hit a soft surface.

64 year old Michael Scully from Sixmilebridge who was the manager of the road works project was given a 12 month suspended sentence after he admitted to two counts of health and safety breaches.
