A temporary injunction which has prevented one of Clare’s two headshops operating for the past fortnight, expires today.
However the owner of the premises which sought the legal restraint against the operator of the Laughing Buddha in Ennis is expected back in court where it’s expected he will seek an extension to the injunction.
On the 26th of March last Limerick Circuit Court granted a temporary injunction to Desmond Houlihan- the owner of 9 A Chapel lane Ennis – which prevented the the tenant Connor Doyle from operating the headshop.
Mr Houlihan a retired solicitor sought the legal restraint on the basis that Mr Doyle mislead him as to the true nature of the business he intended to conduct at the addresses when he signed the lease.
In a statement to Clare FM at the time the Ennis businessman said the tenant informed him that he had a relative who worked with an orphanage charity in Nepal and that souvenirs she sourced, would be sold at the Laughing Buddha.
Mr Houlihan added that when he realised his property was operating as as a head shop he accepted no rent and demanded its closure ..
The temporary injunction he sought takes effect until today where its expected the matter will be before Ennis Circuit Court later.
