High Court hearings have begun regarding Clare County Council’s decision to extinguish a public right of way at Doonbeg Golf Club.
Councillors voted to remove the right of way, which had crossed the club’s 14th fairway, in September 2009, and provided for an alternative one a short distance away
However, James McNulty of Ballingun, West Cree, Kilrush is arguing that the Council acted beyond it’s powers in this decision, and that it breached legislation on grounds including that an oral hearing relating to the proposal lacked fair procedure.
