Not Seeing Outcome Of 10-Year Legal Battle The “Real Tragedy” For Edel Kelly

The solicitor for the family of a Clare woman who died of breast cancer says the real tragedy is that she wasn’t there to witness the outcome of a ten-year legal battle with the HSE.

Kilrush woman Edel Kelly was 26 when she died in 2008, and her family have this week settled a High Court action against the health service.

In the case, her family alleged there was a 13 month delay in diagnosing Edel’s breast cancer and a subsequent delay in treating her. The HSE admitted breach of duty in the case, but did not admit that this had caused Edel’s death.

It was one of a number of cases that led to the overhaul of cancer services across the country and Solicitor for the Kelly Family, Patrick Moylan says the conclusion of the case has brought some comfort to the family:
