Pascal Carmody High Court Challenge

Pascal Carmody’s High Court challenge against the DPP’s decision to re-try him on deception charges is expected to conclude today.

The 61 year old of Ballycuggeran Killaloe is charged with defrauding a number of terminally ill cancer patients on dates between 2001 and 2002.

Yesterday, senior council for Mr Carmody Patrick Marrinan told the High Court that a real and significant difficulty had been created due to the death of an important witness for the defence, Mark Haden- a former patient of the 61 year old.

Mr Marrinan further submitted the delay in prosecuting the case was prejudicial.

However this was disputed by council for the DPP who also rejected arguments that the death of Mr Hadden was prejudicial.

The hearing is expected to conclude today.
