Shatter Appeals High Court Decision

Former Minister for Justice Alan Shatter is appealing the High Court’s decision not to quash certain parts of the Guerin report.

The report was highly critical of his handling of allegations of Garda misconduct in the Cavan/Monaghan division.

The Guerin report was commissioned to look into allegations made by whistleblower Sergeant Maurice McCabe.

It found that Alan Shatter failed to properly investigate his allegations of corruption and malpractice and led to his resignation as Minister for Justice the day after it was published in May 2014.

Last month, he was unsuccessful in his attempt to have parts of the report quashed and he’s appealing that decision today.

Mr. Sean Guerin, a senior counsel, never interviewed Mr. Shatter for his report and by not giving him chance to tell his side of the story, the former Fine Gael TD claims he was denied his right to fair procedures.

His barrister said simple fairness demanded it and claims his client suffered a serious injustice.

He’s also brought up the findings of the O’Higgins Commission of Investigation which vindicated his actions in relation to the allegations.
