West Clare Farmer Charged In Connection With Dumping Of Carcasses To Be Defended By His Brother

A west Clare farmer charged in connection with the alleged dumping of 17 decomposing carcasses at a 300 ft high cliff is to be defended in court by his brother.

62-year old Martin Gerald Foley of Lislanihan, Kilkee is charged in connection with the discovery of the rotting animals at Baltard, Doonbeg in April of last year.

When he last appeared in court in July, Martin Gerald Foley said he had yet to secure legal representation for the case.

Yesterday, at Kilrush District Court, his brother and Galway-based solicitor Oliver Foley confirmed that he was representing the accused.

The two-volume Book of Evidence was served on Martin Gerald Foley, who is charged with disposing of waste in a manner that is likely to cause environmental pollution on dates unknown between April 20th 2013 and March 13th 2014, contrary to the Waste Management Act.

This was after the bloated animals were found close together at the bottom of the isolated cliffs, a discovery which led to four separate investigations by the Gardai, the ISPCA, the Department of Agriculture and Clare Co Council.

In court yesterday, Martin Gerald Foley was told that if an alibi formed any part of his defence, he was to inform the State of this within 10 days

He was returned on existing bail terms to appear before Ennis Circuit Court next month.
